ARTICLE 1. PARTIES
These General Terms and Conditions apply between Welocal, a simplified joint-stock company (SAS), with share capital of €15,000, registered with the Pointe-à-Pitre Trade and Companies Register under number 89833172300038, whose registered office is located at PARC D'ACTIVITÉ DE JABRUN, 97122 BAIE-MAHAULT, France, telephone: +33 9 61 45 96 72, email: communication@airlocal.net, intra-Community VAT number: FR46898331723, hereinafter referred to as “Guadeloupe.airlocal.com”, and any natural or legal person, governed by private or public law, registered on the Site, hereinafter referred to as “the Client.”
ARTICLE 2. DEFINITIONS
“Client”: any natural or legal person, governed by private or public law, registered on the Site.
“Site Content”: elements of any kind published on the Site, whether or not protected by intellectual property rights, such as texts, images, designs, presentations, videos, diagrams, structures, databases, or software.
“Guadeloupe.airlocal.com”: Vela, acting in its capacity as the publisher of the Site.
“Offer”: web pages and any associated digital files published on the Site by the Professional for the sale of a Product.
“Product”: any good or service offered for sale on the Site by the Professional.
“Internet User”: any natural or legal person, governed by private or public law, accessing the Site.
“Service”: a service offered by Guadeloupe.airlocal.com on the Site to connect the Client with a Professional.
“Site”: the website accessible at the URL Guadeloupe.airlocal.com, as well as any related sub-sites, mirror sites, portals, and URL variations.
“Professional”: any natural or legal person, governed by private or public law, registered on the Site for the purpose of selling Products.
ARTICLE 3. SCOPE OF APPLICATION
The Site is freely accessible to any Internet User. Browsing the Site implies acceptance of these General Terms and Conditions by any Internet User. Mere access to the Site, by any means whatsoever, including via a robot or a browser, constitutes full and unconditional acceptance of these General Terms and Conditions. Upon registration on the Site, this acceptance is confirmed by checking the corresponding box.
The Internet User thereby acknowledges having fully read and accepted these terms without restriction.
Checking the aforementioned box shall be deemed to have the same legal value as a handwritten signature by the Internet User. The Internet User acknowledges the evidentiary value of Guadeloupe.airlocal.com’s automated recording systems and, unless proof to the contrary is provided, waives the right to dispute them in the event of a dispute.
These General Terms and Conditions apply to the relationship between the parties to the exclusion of any other conditions, in particular those of the Internet User.
Acceptance of these General Terms and Conditions requires that Internet Users have the necessary legal capacity, or failing that, authorization from a legal guardian or curator if they are legally incapacitated, from their legal representative if they are minors, or that they hold a valid mandate if acting on behalf of a legal entity.
ARTICLE 4. PURPOSE OF THE SITE
The purpose of the Site is to publish information relating to Guadeloupe and its surrounding areas, as well as to present Products and sell them to Clients.
ARTICLE 5. PROVISION OF AN ONLINE MARKETPLACE
Provision of the marketplace
Guadeloupe.airlocal.com undertakes to make an online marketplace available to the Client, enabling them to respond to Offers and thus purchase Products.
Site maintenance
Guadeloupe.airlocal.com undertakes to host and maintain the Site at all times, except during maintenance periods.
ARTICLE 6. ORDER PROCESS
Placing an order
In order to place an order, Internet Users may select one or more Products and add them to their shopping cart. Product availability is indicated on the Site in the description of each item. Once their order is complete, they may access their cart by clicking the button provided for this purpose.
Validation of the order by the Internet User
By reviewing their cart, Internet Users may check the number and nature of the Products selected, as well as their unit price and total price. They may remove one or more Products from their cart.
If the order is satisfactory, Internet Users may validate it. They will then be directed to a form allowing them either to enter their login details if they already have an account, or to register on the Site by completing the registration form with their personal information.
Payment by the Client
Once logged in, or after fully completing the registration form, Clients will be invited to review or modify their delivery and billing details, and then to make payment by being redirected to a secure payment interface displaying the wording “order with obligation to pay” or any equivalent wording.
Order confirmation by Guadeloupe.airlocal.com
Once payment has been effectively received by Guadeloupe.airlocal.com, it undertakes to acknowledge receipt to the Client by electronic means within a maximum period of 24 hours. Within the same timeframe, Guadeloupe.airlocal.com undertakes to send the Client an email summarizing the order and confirming that it is being processed, including all relevant information.
Delivery and after-sales service by the Professional
The Professional is solely responsible for delivery of the Product, for keeping the Client informed during the order processing, and for the proper performance of the contract towards the Client.
ARTICLE 7. PRICE – PAYMENT
Prices
The applicable prices are those displayed on the Site within the Offers on the date of the order. These prices may be modified at any time by the Professional. The prices displayed are valid only on the date of the order and shall not apply in the future.
Prices indicated on the Site are expressed in euros, inclusive of all taxes, excluding delivery costs.
Guadeloupe.airlocal.com receives a commission on the sale of each Product by a Professional. This commission is borne exclusively by the Professional.
Payment methods
The Client may make payment by bank card. Bank card payments are processed through secure transactions provided by STRIPE.
In the context of bank card payments, Guadeloupe.airlocal.com has no access to any data relating to the Client’s payment methods. Payment is made directly to the banking institution.
Invoicing
Guadeloupe.airlocal.com will send or make available to the Client an electronic invoice after each payment. The Client expressly agrees to receive invoices in electronic form.
ARTICLE 8. COMPLAINTS – WITHDRAWAL – WARRANTY
Customer service
The Site’s customer service is available from Monday to Friday, from 9 a.m. to 5 p.m., by email at: communication@airlocal.net, or by postal mail at the address indicated in Article 1 of these General Terms and Conditions. In the latter two cases, Guadeloupe.airlocal.com undertakes to provide a response within three (3) business days.
Right of withdrawal – Distance selling
As the sales contract is concluded between the Client and the Professional, the right of withdrawal relating to the sales contract must be exercised directly with the Professional acting in their professional capacity.
Warranties
As the sales contract is concluded between the Client and the Professional, the latter alone is bound by the warranties relating to the sale vis-à-vis the Client.
Returns
As the sales contract is concluded between the Client and the Professional, any return must be carried out directly by the Client with the Professional.
ARTICLE 9. PERSONAL ACCOUNT
Creation of the personal account
The creation of a personal account is a mandatory prerequisite for any order placed by an Internet User on the Site. For this purpose, the Internet User will be asked to provide a certain amount of personal information. Some of this information is deemed essential for the creation of the personal account. Any refusal by an Internet User to provide such information will prevent the creation of the personal account and, consequently, the validation of the order.
When creating the personal account, the Internet User is invited to choose a password. This password ensures the confidentiality of the information contained in the personal account. The Internet User therefore agrees not to disclose or communicate it to any third party. Failing this, Guadeloupe.airlocal.com shall not be held liable for any unauthorized access to an Internet User’s personal account.
The Client undertakes to regularly review the data concerning them and to update and modify it online via their personal account as necessary.
Content of the personal account
1. General
The personal account allows the Client to view and track all orders placed on the Site and to follow various news feeds relating to the Professionals.
Pages relating to personal accounts may be freely printed by the account holder, but they do not constitute admissible evidence before a court of law. They are for informational purposes only and are intended to ensure efficient order management by the Client.
Guadeloupe.airlocal.com undertakes to securely retain all contractual elements whose retention is required by law or applicable regulations.
2. Internal messaging
An internal private messaging service is made available to Clients. This system is reserved for Clients and Professionals, and the confidentiality of correspondence applies to it.
The contents of inboxes and outboxes are not subject to any guarantee of retention by Guadeloupe.airlocal.com, and it is the responsibility of Clients to back up such content. The loss of this content, whatever the cause, shall not constitute damage for which the Client may claim compensation.
Any Client who is the victim of abuse (spam, unsolicited advertising, or otherwise) may inform Guadeloupe.airlocal.com, which will take all appropriate measures.
3. Client contributions
Clients are given the opportunity to contribute to the content of the Site by publishing comments regarding their use of the Products and their relationship with Guadeloupe.airlocal.com. Comments must be submitted in French. They are subject to validation by Guadeloupe.airlocal.com or its moderation team.
By clicking the “Submit” button to publish a comment, the Client grants Guadeloupe.airlocal.com a free, non-exclusive copyright license for said comment. As such, the Client authorizes Guadeloupe.airlocal.com to make their comment available to the public online, in whole or in part, on the Site, Guadeloupe.airlocal.com newsletters, and the websites of Guadeloupe.airlocal.com partners. The Client authorizes Guadeloupe.airlocal.com to reproduce the comment for the purposes of making it available online and creating communication and promotional materials for the Site. The Client authorizes Guadeloupe.airlocal.com to translate their comment into any language in order to make it available online and reproduce it on commercial and promotional media. The right of adaptation also includes the right to make technically necessary modifications to exploit the comment in other formats. This license is granted for commercial and advertising use, for the entire duration of the rights, and for use in France and abroad.
The Client declares that they hold the necessary intellectual property rights and authorizations to publish their comment. The Client undertakes, at Guadeloupe.airlocal.com’s request, to intervene in any proceedings brought against Guadeloupe.airlocal.com as a result of their comment and to indemnify it against any costs and damages awarded against it, including legal fees.
Deletion of the personal account
Guadeloupe.airlocal.com reserves the right to delete the account of any Client who breaches these General Terms and Conditions, in particular where the Client provides inaccurate, incomplete, misleading, or fraudulent information, or where a Client’s personal account has remained inactive for at least one year. Such deletion shall not constitute a fault on the part of Guadeloupe.airlocal.com or a loss for the excluded Client, who shall not be entitled to any compensation as a result.
This exclusion is without prejudice to Guadeloupe.airlocal.com’s right to initiate legal proceedings against the Client where justified by the circumstances.
ARTICLE 10. PERSONAL DATA
In the context of its services, Guadeloupe.airlocal.com is required to process the personal data of its Clients.
Identity of the data controller
The entity responsible for the collection and processing of data on the Site is Guadeloupe.airlocal.com.
Data collected
1. Data collected from Clients
In the context of its contractual relationships, Guadeloupe.airlocal.com may collect and process Client information, including: last names, first names, dates of birth, telephone numbers, postal addresses, email addresses, bank details, photographs, web behavior data, and online consumption data.
2. Purposes of personal data collection
Data collected during the contractual relationship is subject to automated processing for the following purposes:
- performance of contractual obligations;
- responding to Client requests;
- contacting Clients;
- preventing unlawful or illegal activity;
- enforcing the General Terms and Conditions;
- initiating legal proceedings;
- verifying Client identity.
Legal basis for processing
The legal basis for processing the collected data is the contractual relationship.
3. Data recipients
The collected data may only be accessed by Guadeloupe.airlocal.com, strictly within the limits necessary for the performance of contractual obligations.
Such data, whether individual or aggregated, is never made freely accessible to any third natural person.
4. Data retention period
The collected personal data is retained for the duration of the contractual relationship and for the period during which Guadeloupe.airlocal.com’s liability may be engaged.
After the retention period has elapsed, Guadeloupe.airlocal.com undertakes to permanently delete the data of the persons concerned without retaining any copy.
5. Security and confidentiality of personal data
Personal data is stored under secure conditions, using current technical means, in compliance with the General Data Protection Regulation (GDPR) and applicable national legislation.
Access to Guadeloupe.airlocal.com premises is also secured.
6. Data minimization
Guadeloupe.airlocal.com may also collect and process any data voluntarily transmitted by its Clients.
Guadeloupe.airlocal.com guides its Clients to provide only the personal data strictly necessary for the performance of contractual obligations.
Guadeloupe.airlocal.com undertakes to retain and process only the data strictly necessary for its professional activities and to delete any data received that is not useful to its activities as soon as possible.
Respect for rights
Clients of Guadeloupe.airlocal.com have the following rights regarding their personal data, which they may exercise by writing to Guadeloupe.airlocal.com’s postal address or by completing the online contact form.
1. Right to information, access, and communication of data
Clients of Guadeloupe.airlocal.com may access the personal data concerning them.
Due to the obligation of security and confidentiality in the processing of personal data incumbent upon Guadeloupe.airlocal.com, requests will only be processed if Clients provide proof of their identity, in particular by producing a scan of a valid identity document (for requests made via the dedicated electronic form) or a signed photocopy of a valid identity document (for requests submitted in writing), both accompanied by the statement: “I hereby certify on my honor that this copy of the identity document is a true copy of the original. Done at … on …”, followed by their signature.

2. Right to rectification, erasure, and the right to be forgotten
Clients of Guadeloupe.airlocal.com may request the rectification, updating, restriction, or erasure of their personal data that may prove to be inaccurate, incorrect, incomplete, or obsolete.
Clients may also define general or specific instructions regarding the handling of their personal data after their death. Where applicable, the heirs of a deceased person may request that the death of their relative be taken into account and/or that necessary updates be carried out.

3. Right to object to data processing
Clients of Guadeloupe.airlocal.com may object to the processing of their personal data.

4. Right to data portability
Clients of Guadeloupe.airlocal.com have the right to receive the personal data they have provided to Guadeloupe.airlocal.com in a transferable, open, and readable format.
5. Right to restriction of processing
Clients of Guadeloupe.airlocal.com have the right to request that the processing of their personal data by Guadeloupe.airlocal.com be restricted. In such case, their data may only be stored and no longer used by Guadeloupe.airlocal.com.
6. Response time
Guadeloupe.airlocal.com undertakes to respond to any request for access, rectification, objection, or any other additional request for information within a reasonable timeframe, which shall not exceed one (1) month from receipt of the request.
7. Complaint to the competent authority
If Clients of Guadeloupe.airlocal.com consider that Guadeloupe.airlocal.com is not complying with its obligations regarding their personal data, they may submit a complaint or request to the competent authority. In France, the competent authority is the CNIL, to which a request may be submitted here.
Transfer of collected data
1. Transfer to partners
Guadeloupe.airlocal.com uses authorized service providers to facilitate the collection and processing of Client data. These service providers may be located outside the European Union.
Guadeloupe.airlocal.com has ensured in advance that its service providers implement appropriate safeguards and comply with strict conditions regarding confidentiality, use, and data protection, for example through the former U.S. Privacy Shield framework.

2. Transfer upon legal request or court order
Clients also consent to Guadeloupe.airlocal.com disclosing the collected data to any person upon request by a governmental authority or pursuant to a court decision.
3. Transfer in the event of a merger or acquisition
If Guadeloupe.airlocal.com is involved in a merger, asset sale, financing transaction, liquidation, bankruptcy, or acquisition of all or part of its business by another company, Clients consent to the collected data being transferred by Guadeloupe.airlocal.com to such company, and to that company carrying out the personal data processing referred to in these General Terms and Conditions in place of Guadeloupe.airlocal.com.
ARTICLE 11. LIABILITY OF GUADELOUPE.AIRLOCAL.COM
Nature of Guadeloupe.airlocal.com’s obligations
Guadeloupe.airlocal.com acts under these terms as a completely neutral technical service provider making an online electronic platform available. Guadeloupe.airlocal.com is subject only to an obligation of means with respect to the provision of the online electronic platform.
Guadeloupe.airlocal.com plays no active role that would allow it to have knowledge of or control over the Offers published on the Site. Guadeloupe.airlocal.com provides no assistance to Professionals in optimizing or promoting their Offers. It is the responsibility of the Professional to publish and perform the Offers and to fulfill their obligations toward the Client.
Guadeloupe.airlocal.com is not bound by the obligations of the Professional toward Clients.
Force majeure – Client fault
Guadeloupe.airlocal.com shall not be held liable in cases of force majeure or Client fault, as defined below:
1. Force majeure
For the purposes of these General Terms and Conditions, force majeure shall include any impediment, limitation, or disruption of the Service resulting from fire, epidemic, explosion, earthquake, bandwidth fluctuations, failure attributable to the access provider, failure of transmission networks, collapse of installations, unlawful or fraudulent use of passwords, codes, or references provided to the Client, hacking, security breaches attributable to the Site host or developers, flooding, power outages, war, embargo, laws, injunctions, demands or requirements of any government, requisition, strike, boycott, or any other circumstances beyond the reasonable control of Guadeloupe.airlocal.com. In such circumstances, Guadeloupe.airlocal.com shall be released from its obligations to the extent of such impediment, limitation, or disruption.
2. Client fault
Client fault shall include any misuse of the Service, fault, negligence, omission, or failure by the Client or their representatives, failure to comply with advice provided by Guadeloupe.airlocal.com on its Site, any unlawful disclosure or use of passwords, codes, or Client references, as well as the provision of incorrect information or failure to update such information in the personal account. The use of any technical process such as robots or automated requests that contravenes the letter or spirit of these General Terms and Conditions shall also constitute Client fault.
Technical issues – Hyperlinks
In the event that access to the Site is impossible due to technical issues of any kind, the Client may not claim damages or compensation. The unavailability, even prolonged and without time limitation, of one or more online services shall not constitute harm to Clients and shall not give rise to damages payable by Guadeloupe.airlocal.com.
Hyperlinks present on the Site may lead to other websites. Guadeloupe.airlocal.com shall not be held liable if the content of such sites violates applicable laws, nor if visiting such sites causes harm to the Internet User.
Damages payable by Guadeloupe.airlocal.com
Unless otherwise required by law or regulation, Guadeloupe.airlocal.com’s liability is limited to direct, personal, and certain damage suffered by the Client and related to the failure in question. Guadeloupe.airlocal.com shall not be liable for indirect damages, including but not limited to loss of data, commercial losses, loss of orders, damage to brand image, business disruption, or loss of profits or customers. In any event, and within the same limits, the total amount of damages payable by Guadeloupe.airlocal.com shall not exceed the price of the Product ordered.
Hyperlinks and Site content
The Site Content is published for informational purposes only and without any guarantee of accuracy. Guadeloupe.airlocal.com shall not be held liable for any omission, inaccuracy, or error contained in such information that may cause direct or indirect damage to the Internet User.
Liability as a hosting provider
Data, including comments, published on the Site by Clients is published under their sole responsibility.
In this respect, Guadeloupe.airlocal.com benefits from the status of hosting provider within the meaning of Article 6-I-2 of the French Law for Confidence in the Digital Economy of 21 June 2004. In accordance with paragraph 3 of the same article, Guadeloupe.airlocal.com shall not incur civil or criminal liability for such content unless, upon becoming aware of unlawful activity or information, it fails to act promptly to remove such content or disable access to it.
ARTICLE 12. INTELLECTUAL PROPERTY
Legal protection of Site Content
The Site Content may be protected by copyright and database rights. Any unlawful representation, reproduction, translation, adaptation, or transformation, in whole or in part, carried out without the consent of Guadeloupe.airlocal.com or its rights holders constitutes an infringement of Books I and III of the French Intellectual Property Code and may give rise to legal action for infringement.
Contractual protection of Site Content
The Internet User contractually undertakes not to use, reproduce, or represent the Site Content, whether protected by intellectual property rights or not, for any purpose other than reading it via a robot or browser. This prohibition does not apply to indexing robots whose sole purpose is to scan Site content for indexing.
ARTICLE 13. FINAL PROVISIONS
Applicable law
These General Terms and Conditions are governed by French law.
Amendments to the General Terms and Conditions
Guadeloupe.airlocal.com may amend these General Terms and Conditions at any time. The applicable terms are those in force on the date of the Client’s order or connection to the Site, any new connection to the personal account constituting acceptance of the amended terms where applicable.
Disputes
In the event of a dispute relating to the performance of these General Terms and Conditions, the User (or Client) is invited to seek an amicable solution by first contacting the Publisher’s customer service.
Failing an amicable agreement, the consumer User may refer the matter free of charge to a consumer mediator registered on the national list maintained by the National Council of Mediation (CNM), in accordance with Articles L.611-1 et seq. of the French Consumer Code. Information on how to refer a matter and the updated list of mediators is available at: www.economie.gouv.fr/mediation-conso.
Since 20 July 2025, the European Online Dispute Resolution (ODR) platform has no longer been accessible. For cross-border disputes, users should contact the European Consumer Centre France (www.europe-consommateurs.eu).
Any dispute not falling within the competence of a mediator may, failing amicable agreement, be submitted to arbitration in accordance with the rules of the Digital Institute of Arbitration and Mediation (IDAM), via the Fast-Arbitre platform (www.fast-arbitre.com), if contractually agreed by the parties.
Entire agreement
The invalidity of any clause of this contract shall not affect the validity of the remaining clauses or of the contract as a whole, which shall remain in full force and effect. Where possible, the parties shall replace the invalid provision with a valid provision consistent with the spirit and purpose of these terms.
Non-waiver
The failure of Guadeloupe.airlocal.com to exercise any right granted under these terms shall not be construed as a waiver of such right.
Telephone solicitation
Clients are informed that they may register on the telephone solicitation opt-out list at: http://www.bloctel.gouv.fr/.
Language of the General Terms and Conditions
These General Terms and Conditions are provided in French.
Unfair terms
The provisions of these General Terms and Conditions apply subject to compliance with the mandatory provisions of the French Consumer Code relating to unfair terms in contracts concluded between a professional and a consumer.
